Terms and Conditions

Top Shelf Carpentry & Joinery – Terms & Conditions These Terms and Conditions apply to all quotations, works, and services provided by Top Shelf Carpentry & Joinery (“the Contractor”) to the Client. By accepting a quotation, issuing a purchase order, or instructing the Contractor to proceed with works, the Client agrees to these Terms and Conditions. 1. Quotations 1.1 All quotations are valid for 30 days from the date of issue, unless otherwise stated in writing. 1.2 Prices may be subject to change after the validity period due to increases in material, labour, or supplier costs. 1.3 Any variations or additional works not included in the original quotation will be charged separately and must be approved by the Client. 2. Payment Terms 2.1 Payment terms are strictly as stated on the invoice. 2.2 Unless otherwise agreed in writing, all invoices are payable within 7 days from invoice date. 2.3 Progress payments may be required for larger projects and will be outlined in the quotation or contract. 2.4 The Contractor reserves the right to suspend or cease works if payments are not made in accordance with the agreed terms. 3. Late Payment, Fees & Collections 3.1 If payment is not received by the due date, the account will be considered overdue. 3.2 The Contractor reserves the right to charge administration fees, interest on overdue amounts (at the maximum rate permitted by law), and any costs associated with recovering the debt, including legal fees, debt collection agency fees, and court costs. 3.3 The Client agrees that overdue accounts may be referred to a debt collection agency and may be reported to credit reporting bodies (credit watch agencies), which may affect the Client’s credit rating. 4. Ownership of Materials (Retention of Title) 4.1 All materials supplied and/or installed by the Contractor remain the sole property of Top Shelf Carpentry & Joinery until payment is made in full for the entire project. 4.2 If payment is not made, the Contractor reserves the right to enter the site (where lawful and safe to do so) and remove any supplied materials or installed items without liability for damage caused by removal, to the extent permitted by law. 4.3 Risk in the materials passes to the Client upon delivery or installation, but ownership does not transfer until full payment is received. 5. Delays & Access 5.1 The Client must provide safe, clear, and uninterrupted access to the site during agreed working hours. 5.2 The Contractor is not responsible for delays caused by weather, supplier shortages, other trades, site conditions, or events beyond reasonable control. 5.3 Additional costs caused by delays outside the Contractor’s control may be charged to the Client. 6. Warranties & Defects 6.1 All workmanship is carried out in accordance with industry standards and applicable building regulations. 6.2 Any defects must be reported in writing within 7 days of completion. 6.3 This warranty does not cover fair wear and tear, damage caused by misuse, alterations by others, or environmental conditions, or materials supplied by the Client. 7. Cancellations 7.1 If the Client cancels works after acceptance of a quote, the Contractor may charge for work already completed, materials ordered or fabricated, and any reasonable loss incurred due to the cancellation. 8. Governing Law 8.1 These Terms and Conditions are governed by the laws of Western Australia, and the parties submit to the jurisdiction of WA courts
